Elder Care Legal Plan

There are about 45 million Americans over the age of 60 and approximately every seven (7) seconds another American turns 55. As you might expect from these statistics, elder law is one of the fastest growing segments in the legal arena.

Elder law is not one specific type of law, but a wide range of legal areas that focus on issues specific to older Americans. Elder law is not just for senior citizens though, as it deals with issues that aging baby boomers should be aware of as well.

Legal Care Direct™ (LCD) has a network of thousand of attorneys in all 50 states that have contracted to provide members with free and discounted legal care. Many of our attorneys specialize in the area of Elder Care and as such can provide our elder members and their families with the legal care they need. As members, they will be entitled to numerous free and discounted services provided by our attorneys.


Free Legal Care*

Members will be entitled to unlimited free services for each new legal matter. They are as follows:

  • Initial face to face consultation for each new legal matter (no time limit)
  • Initial over the phone consultation for each new legal matter (no time limit)

    Consultations include issues such as:

    • Wills
    • Trusts
    • Probate
    • Health Directives
    • Fraud
    • Discrimination
    • And much, much more
  • Plan attorneys will make phone calls on your behalf for each new legal matter if they determine that a phone call is the appropriate course of action.
  • Plan attorneys will write letters on your behalf for each new legal matter if they determine that a written correspondence is the appropriate course of action.
  • Assistance in solving problems with government programs such as Welfare, Medicare and Medicaid.
  • Each member will be provided with a free simple will and have it updated for free each year. A will is a legally valid document that outlines how one's money, property or other assets are transferred when he or she dies.
  • Plan attorneys will review legal documents for members (six pages per document).

* In many states, attorney liability may require plan attorneys to obtain a retainer from the member prior to providing some of the free member benefits.

It is important to have any legal document reviewed prior to executing one. Our pre-qualified plan attorneys will review member’s legal documents, which could include trusts, living wills, advanced directives or powers of attorney.

Quite often as elderly persons get their affairs in order, they will need to update their wills and trusts and may even find themselves in a situation where filing for bankruptcy is necessary. Many elderly will sell their homes and down size or move into an adult community living facility later on in life. Our plan attorneys can make these processes inexpensive and painless.

** Court costs, filing fees and time charged for travel to and from courts are additional.

Guaranteed Low Hourly Rates

Plan attorneys have contracted to charge no more than $125.00 per hour, or 40% off their usual and customary hourly rate, whichever is greater, for legal care that goes beyond the free and discounted services described above.

In the case of extended legal care, plan attorneys may ask you for a retainer. Any retainer sought will be computed by multiplying the number of hours a plan attorney believes a case will take, by the appropriate discounted hourly plan rate. For instance; 10 hours x $125.00 = a retainer of $1,250.00. Any unused portion of the retainer will be returned to you. This represents as much as a 40% savings off an attorneys usual hourly charge.

Many of the attorneys who practice in the field of elder law frequently work with doctors, social workers, long term care professionals and financial planners in an effort to maximize their client's outcomes.

Membership includes the member, their spouse, any children and any dependents living with the member that may be financially dependent upon them, such as a live in companion, grandchild or elderly friend.
